Acceptable Use Policy of Alliance Business Solutions.COM Servers
Terms of Service: Your Rights and Responsibilities

Alliance Business Solutions (referred hereinafter as 'Alliance Business Solutions', 'Alliance Servers', 'Alliance', 'our', 'we' and 'us') is a internet and business solutions firm. All accounts on our web servers, including single-domain, reseller and resold accounts, are subject to the terms and conditions described in this document. Under the terms of this agreement, your placement of information on our servers is an acknowledgement that you have read, understand, and agree to be by terms and conditions below.

1. User Conduct

Our services may only be used for lawful purposes -- any use of these services which violates any laws which may apply to Alliance Business Solutions, your local jurisdiction, or any jurisdiction that you or your site may be subject to is strictly prohibited.

This means that while using the service, you may not:

Post or transmit any unlawful, threatening, abusive, defamatory, obscene, libellous, offensive, indecent, profane, or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offensive, give rise to civil liability, or otherwise violate any law and restrict or inhibit any other user from using and enjoying the Internet.

2. Resource Usage, Illegal content and Adult-Oriented Sites

Users may not initiate the following on our servers:

Run any process that requires more than 8Mb of memory space, more than 30 CPU seconds, or use more than 5% of all available system resources at any time.

Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed. Run stand-alone, unattended server-side processes at any point in time on the server.

This includes any and all daemons, such as IRCD. Run any software that interfaces with an IRC (Internet Relay Chat) network.

Run any site with adult-oriented content, including but not limited to any nude or pornographic material, except on servers where we specifically allow adult material.

Pornography and sex-related merchandising is prohibited on all Alliance Business Solutions.com servers except on servers where we specifically allow adult material. This includes equally sites that LINK to such content.

Databases are only to be used for Alliance Business Solutions-hosted web sites, and no outside usage of our hosted databases is allowed.

Examples of Unacceptable content or links:

Pirated software

Hacker programs or archives

Warez sites

ILLEGAL COPYRIGHTED MP3's OR linking to or hosting them.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to Alliance Business Solutions.com servers or any other server on the internet. Links to such materials are also prohibited.

Alliance Business Solutions reserves to the right to the final decision on what constitutes abuse.

3. Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, commonly known as spam. Any user who sends out spam will have their account terminated without notice; this includes reseller and resold accounts.

Alliance Business Solutions reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. Alliance Business Solutions also reserves the right to make any such modifications in an emergency at our sole discretion.

4. Indemnification

You agree to indemnify, defend, and hold harmless Alliance Business Solutions from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting indirectly from your use of the service which damages either you, Alliance Business Solutions, or any other party or parties without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with your account, including but not limited to domain name selection and Web site content.

5. Refusal or discontinuation of service

Alliance Business Solutions reserves the right to refuse or discontinue service to anyone at Alliance Business Solutions' sole discretion. Alliance Business Solutions may deny you access to all or part of the service without notice if you engage in any conduct or activities that Alliance Business Solutions in its sole discretion believes violates any of the terms and conditions in this agreement. Alliance Business Solutions shall have no responsibility to notify any third-party providers of services, merchandise, or information, nor any responsibility for any consequences resulting from such discontinuance or lack of notification. You agree that Alliance Business Solutions has the right to monitor the service electronically from time to time and to disclose any information as necessary to satisfy the law, or to protect itself or its subscribers. Alliance Business Solutions reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this agreement. Alliance Business Solutions also reserves the right to refuse refunds in cases where Alliance Business Solutions believes abuse has taken place.

6. No warranties

Alliance Business Solutions makes no warranties or representations, except the money back guarantee policy as advertised, of any kind for the services being offered. The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement, or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by Alliance Business Solutions or its agents or employees shall create a warranty. Alliance Business Solutions provides no warranty that the service will be uninterrupted or error free or that any information, software or other material accessible on the service is free from viruses or other harmful components. Under no circumstances shall Alliance Business Solutions be liable for any direct, indirect, special, punitive, or consequential damages that result in any way from your use of or inability to use the service, or for third parties' use of the service to access your Web space, or to access the Internet or any part thereof, or your or any third parties' reliance on or use of information, services, or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance. If you are dissatisfied with Alliance Business Solutions service or any of its terms, conditions, rules, policies, guidelines, or practices, you’re sole and exclusive remedy is to discontinue using the service.

You understand that by placing information on Alliance Business Solutions' servers that such information becomes available to all Internet users and that Alliance Business Solutions has no way of limiting or restricting access to such information or protecting such information from copyright infringement. You assume total responsibility and risk for your use of Alliance Business Solutions' servers and the Internet. It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise provided through Alliance Business Solutions or on the Internet generally.

Your use of the service is at your sole risk. Alliance Business Solutions is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Alliance Business Solutions servers.

You agree not to interfere with the operation of the system. You further agree not to interfere with the proper operation of other systems reachable through the Internet, including any attempt at unauthorized access. You agree to adhere to system policies as published by Alliance Business Solutions, including restrictions on services available with each service type, restrictions on certain features, and all other policies.

Alliance Business Solutions reserves the right to monitor any and all communications through or with our facilities. You agree that Alliance Business Solutions is not considered a "secure communications medium" for the purposes of the ECPA, and that no expectation of privacy is afforded.

7. DISCLAIMER OF WARRANTY
THE SERVICES, ALLIANCE BUSINESS SOLUTIONS WEB-HOSTING, INCLUDING WITHOUT LIMITATION, ALL PRODUCTS AND SERVICES DISPLAYED OR OFFERED ON THE ALLIANCE BUSINESS SOLUTIONS WEB-HOSTING, AND ALL TEXT, GRAPHICS, LINKS AND APPLICATIONS ARE PROVIDED TO CLIENT ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. ALLIANCE BUSINESS SOLUTIONS WEB-HOSTING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EACH OF THE FOREGOING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM A COURSE OF DEALING. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ALLIANCE BUSINESS SOLUTIONS WEB-HOSTING SPECIFICALLY DISCLAIMS ANY WARRANTY THAT (1)THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (2) DEFECTS WILL BE CORRECTED; (3) THERE ARE NO VIRUSES OR OTHER HARMFUL COMPONENTS; AND (4) THE SECURITY METHODS EMPLOYED WILL BE SUFFICIENT.

8. LIMITATION OF LIABILITY
IN NO EVENT SHALL ALLIANCE BUSINESS SOLUTIONS WEB-HOSTING BE LIABLE FOR DAMAGES RESULTING FROM LOSS OF DATA, PROFITS, USE OF THE ALLIANCE BUSINESS SOLUTIONS WEB-HOSTING SITE OR ANY ALLIANCE BUSINESS SOLUTIONS WEB-HOSTING PRODUCTS OR SERVICES, OR FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT OR IN CONNECTION WITH ANY PRODUCTS OR SERVICES PROVIDED HEREUNDER. IN NO EVENT SHALL ALLIANCE BUSINESS SOLUTIONS WEB-HOSTING CUMULATIVE LIABILITY EXCEED AN AMOUNT GREATER THAN FIFTY DOLLARS ($50 USD).

9. Account-Holder Identification Information

You agree that you as the person legally responsible for all use of this account, are at least 18 years of age. If you are under 18 years of age, you need to have parental consent in order to sign up, and the account must be ordered by a parent or guardian, in their own name. You agree to supply Alliance Business Solutions with a current and truthful name, postal address and telephone number for our records, and you have a continued obligation to keep this information current. You also agree that you are an authorized user of any credit card that you supply to us, and you understand and agree that we have an obligation to fully investigate any possible fraudulent credit card use.

10. Violation of the Terms and Conditions

As an account holder and/or reseller, you are responsible for your client's account's. If one of your clients is in violation of the terms and conditions, we reserve the right to suspend or terminate the account at our sole discretion, depending on the severity of the violation and will inform you at the email address provided to us at the signup. If your account reseller or otherwise is in violation of the terms and conditions, the same rules apply. If you or any of your customers violate these terms within the 30-days money back guarantee we will suspend or close the account and you forfeit any payments made before the 30-days money back guarantee period.

11. Payment & Other Information

you agree to supply appropriate payment for the services received from Alliance Business Solutions, in advance of the time period during which such services are provided. You agree that until and unless you notify Alliance Business Solutions of your desire to cancel any or all services received, those services will be billed on a recurring basis.

12. Agreement Acknowledgement

This agreement supersedes any written, electronic, or oral communication you may have had with Alliance Business Solutions or any agent or representative thereof, and constitutes the complete and total agreement between the parties. In the event that any provision of this agreement is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect and said provision shall be reformed only to the extent necessary to make it enforceable.

Alliance Business Solutions reserves the right to change this Usage Policy at any time without prior notification.

By placing and continuing to maintain or place information on Alliance Business Solutions' servers you are stating and acknowledging that you have read the aforementioned terms and conditions and that you understand such terms and conditions and agree to be bound by them.

13. Money Back Guarantee

Each hosting or reseller plan includes a full 30-days money back guarantee from day one of accepting these conditions (AUP).

If you are not completely satisfied with our services within the refund time period of 30 days, you will be given a full refund of the contract amount excluding overages or any setup fee's that may apply. No refund is available after that period. This policy does not apply to any additional services such as overages, disk space, bandwidth, maintenance fees, etc.

Accounts cancelled/terminated by Alliance Business Solutions for violating our Acceptable Usage Policy do not qualify for the 30-day money back guarantee. Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund. 14. Resellers

Resellers and their clients are bound by these same Policies, Guidelines and Disclaimers. By reselling and purchasing Alliance Business Solutions.com Services, you hereby agree that Alliance Business Solutions.com Shall not be held liable for any promises or failure of same that Reseller's extend to their clients, including but not limited to, quality of service, financial obligations, financial losses or any other claim NOT provided to Reseller in writing by Alliance Business Solutions.com. It is the legal duty and obligation of the Reseller to provide these policies and guidelines to its entire client's.

Unlimited Traffic Availability* means
That you have at your disposal all you need, actual bandwidth allowed is found in Features of each plan.

15. Payment of Fees

Payments of Webhosting fees are due on the first day of the service period. Payments not received by Alliance Business Solutions main accounts office by the fifth day of the service period will be subject to service interruption and subsequent reconnect fees. Services interrupted due to lack of payment will be subject to a $30.00 reconnect fee for each hosting account and maximum $250.00 reconnect fee for dedicated or co-located server.

16. Over usage charges for bandwidth and space

Over usage fees can occur on all hosting accounts. Account Holder is responsible for these overuse charges. Account Holder may request a temporary suspension on their account so to not exceed this limit or any set limit. Hosting Bandwidth overcharges are in the amount of $3.00/GB on all plans when exceeding your plan limit, or $1.50 per GB if prepaid. All bandwidth over usage will be rounded up to the nearest GB and charged to the customer the next billing period. Account Holders may view their usage accounts via their web site statistics program. Statistics are updated on a daily basis. Alliance Business Solutions may at their discretion disconnect service from clients who are seriously exceeding their plans bandwidth limits for that month and have the right to charge customer credit cards accordingly. Alliance Business Solutions will make attempt to contact owner prior to disconnection or charging there card in event of a problem via email, or phone. Alliance Business Solutions may request a down payment from account holders severely over their monthly limits and use this as a deposit for future over usage payments.

17. Technical Support and NOT normal support issues.

We will endeavour to help our customers as much as possible with problems they might arise. This is what we call "normal support issues" and this goes as far as major problem that effects the whole server and our current customer base. If a customer requires specific technical help that we deem outside our scope of "normal support issues" we will make a charge of $75.00 per hour or part hour for our technicians to investigate the problem and advise or fix which ever is the case, this includes reinstalling customer database's that they may need reinstalling from a backup.

We will advise a customer as much as possible in resolving there problems and if support is required that falls outside "normal support issues" then please email support with a detailed a possible the requirement and authorisation to charge your card accordingly.

18. Proper Termination of Account

If you no longer need Alliance Business Solutions services, then you agree to take the proper actions to cancel your account by visiting our customer helpdesk or by notifying us at least 3 days prior to your ending term, with proper identification and instructions.

By applying for an account you are agreeing to these terms and conditions stated above.

19. Refusal of Service:

We reserve the right to refuse, cancel, or suspend service at our sole discretion.

20.Privacy:

No information provided by you to us is sold to any outside 3rd party for any reason. All data is encrypted and Clients volunteer their own information, opinions about our services.
